Congratulations to Tony Abeln for obtaining a Defense Verdict on behalf of our client, an attending cardiologist, in Worcester Superior Court, at the conclusion of a two-week jury trial. In this case, the Plaintiff’s wrongful death claim centered on the allegedly negligent discharge of a 65-year-old patient from the hospital after a cardiac ablation and pacemaker placement. After suffering ventricular tachycardia during her hospital stay and passing away hours after discharge, the Plaintiff’s estate alleged that the patient was improperly discharged without an ICD or wearable LifeVest. The defense of the case centered on an extensive review of the thoughtful and well-documented approach our client undertook to determine the patient was a proper candidate for discharge as well as expert testimony confirming that the patient’s death, while tragic, was a wholly unexpected and unforeseeable event. After closing arguments, the jury deliberated for two hours before returning a verdict for our client on all counts.
