The HMDR&S Trial Team of Donna Marcin and Toby Bright obtained a well-earned Defense Verdict in Middlesex Superior Court. This case involved allegations that our client, a Thoracic Surgeon, failed to appreciate an increased risk of a complication during a diagnostic procedure. Through expert medical testimony, and strong cross examination, Donna and Toby were able to demonstrate to the jury that this patient was at no higher risk of complication but in fact experienced a rare and unforeseeable complication, to which the defendant responded appropriately intraoperatively and well within the accepted standard of care.
