Congratulations to Patti Murphy and Bob Hamel who obtained Dismissal of claims under the Massachusetts Wage Act and G.L. c. 151, § 1A on behalf of our client for failure to state a claim and lack of personal jurisdiction. This case posed an interesting jurisdictional question where our client was an out-of-state hospital, and the plaintiff resided and worked remotely as a recruiter for our client in Massachusetts. Our Motion to Dismiss emphasized that our client did not target Massachusetts as a market for its services, derived no revenue from Massachusetts, and otherwise did not have sufficient contacts with Massachusetts to warrant the exercise of jurisdiction. In a detailed decision, the Court agreed, further noting that our client’s domicile state had a greater interest than Massachusetts in the employment relationship between our client and the plaintiff, and dismissing all claims.
