Kimberly is an experienced and accomplished civil litigator and trial attorney who focuses her practice on the defense of hospitals, physicians, nurses, and other healthcare professionals and institutions in both medical malpractice actions and Board disciplinary matters. She also maintains an appellate practice, handling complex legal issues in a wide range of substantive areas. Prior to joining HMDR&S, Kimberly was a partner at a large litigation firm where she also specialized in medical malpractice defense.
Kimberly represents clients in federal and state courts in Massachusetts, as well as before professional licensing boards, and has secured countless favorable resolutions on behalf of her clients, including trial victories, appellate wins, summary judgment rulings, and dismissals. She also serves as an appointed member of the Massachusetts Bar Association’s Judicial Administration Council, which promotes the fair and impartial administration of justice in courts across the Commonwealth and, with members of both bench and bar, monitors the needs of the Massachusetts courts and supports proposals for enhancing their efficiency.
Kimberly graduated magna cum laude from Suffolk University Law School and with the highest distinction in the Civil Litigation Concentration. Prior to law school, Kimberly earned Bachelor of Arts degrees in History and Psychology from the University of Massachusetts, Amherst’s Commonwealth Honors College, graduating magna cum laude as a dual degree recipient.
Outside of work, Kimberly enjoys spending time with her husband, Michael, and two sons.
Representative Experience
- Trial counsel in multiple multi-week medical malpractice jury trials and general liability trials;
- Obtained summary judgment on behalf of numerous clients in both federal and state court;
- Obtained numerous case dismissals with successful motions to dismiss in both federal and state court;
- Obtained numerous dismissals of disciplinary matters against physicians and nurses at the boards that license them.
Recent Successful Results Kimberly has Achieved on Behalf of her Clients Include:
- Obtained defense verdict on behalf of her hospitalist client in a wrongful death medical malpractice action following a three-week jury trial in Worcester Superior Court;
- Achieved summary judgment for, and dismissal of all claims against, her client, a cryogenic facility, in the United States District Court for the District of Massachusetts in a complex reproductive medicine case wherein it was alleged that Kimberly’s client negligently caused the loss and destruction of the Plaintiff’s frozen oocytes;
- Achieved summary judgment in the United States District Court for the District of Massachusetts on behalf of her client, a security services provider, in the matter of Steiner et al. v. eBay, Inc. et al., 21-CV-11181(D. Mass.), resulting in the dismissal of all claims, both direct and vicarious, against her client. The case involved complex claims arising from the criminal stalking and harassment campaign orchestrated and conducted by eBay security team members, including one employed by Kimberly’s client, against the Plaintiffs, with damages sought exceeding $500 million;
- Achieved summary judgment on all claims against her interventional radiologist client in a “retained foreign object” medical malpractice action arising from the separation and retainment of a portion of a medical device during her client’s surgical removal of the device;
- Successfully defended an appeal on behalf of her therapist client in the United States Court of Appeals for the First Circuit, which affirmed the dismissal Kimberly had secured for her client in the United States District Court for the District of Massachusetts.
