Toby Bright and Jim Wilkinson – Jury Verdict

Congratulations to the HMDR&S Trial Team of Toby Bright and Jim Wilkinson in obtaining a defense verdict on behalf of our clients last week in Suffolk Superior Court.  The plaintiff in this case alleged that our defendant failed to expedite delivery despite a concerning fetal heart monitor tracing. The plaintiff further alleged that the baby suffered repeated head compressions causing severe and permanent neurological injury post-birth. The defense was able to present expert evidence to support the fact that the labor and delivery was managed appropriately and that delivery was expedited as soon as it was indicated. The defense also successfully presented evidence that the plaintiff’s causation theory was medically deficient and that the baby’s injuries were attributable to congenital abnormalities and related complications after birth. After deliberations, a jury of fourteen returned a defense verdict on all counts in favor of our client.
